1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Spettro VPN service (the "Service") provided by Spettro ("we," "us," or "our"). The Service provides subscription-based access to WireGuard and Amnezia-WG configuration files for VPN connections, delivered via your user dashboard. We do not provide VPN software or applications; users are responsible for obtaining and configuring compatible VPN clients. By subscribing to or using the Service, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.

Our Privacy Policy (https://www.spettro.io/legal/privacy-policy) is incorporated by reference and explains how we handle your data.

2. Eligibility and Account Registration

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. By registering, you represent that you meet this requirement and that all information you provide (e.g., email, billing details) is accurate, complete, and current. You must update your information as needed. Accounts are non-transferable and for individual use only. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. Description of the Service

Upon subscription activation, we allocate resources including one (1) static IP address for the base plan. Additional static IP addresses can be added as extra subscription items for an additional fee. Configuration files are delivered through your user dashboard. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, without liability.

4. Subscriptions and Payments

Subscriptions are managed differently based on your payment method:

• Stripe Payments: Subscriptions via Stripe are recurring and auto-renew at the end of each billing period (monthly, annually, or as selected) unless canceled. You authorize us to charge your selected payment method for the subscription fees, including any applicable taxes, on a recurring basis.

• Cryptomus Payments (Cryptocurrency): Subscriptions via Cryptomus are non-recurring. You must manually extend your subscription by one month at a time through a new payment when you choose. Upon payment confirmation, your subscription is extended, and resources are allocated. If you do not extend your subscription before it expires, your subscription will be canceled, and allocated resources (e.g., static IP addresses) will be removed.

• Fees: Current pricing is available on our website (https://www.spettro.io). Fees may change with 30 days' notice.

• Billing: For Stripe, charges occur at the start of each billing cycle. For Cryptomus, charges occur upon manual extension. You agree that all charges are authorized and that you will not dispute legitimate charges with your payment provider without first contacting us to resolve any issues.

• Crypto Payments: Payments via Cryptomus are final upon blockchain confirmation and subject to network fees, which are your responsibility.

Failure to pay or extend your subscription may result in suspension or termination of your Service without refund.

5. Refund Policy

All sales are final and non-refundable, except where required by law. We do not offer refunds for partial periods, unused time, or dissatisfaction with the Service. If you believe a charge was unauthorized or erroneous, contact us at support@spettro.io within 7 days of the charge. By subscribing, you acknowledge that you understand the no-refund policy and agree not to initiate chargebacks or disputes for authorized transactions. In the event of a chargeback or dispute, we may terminate your account and pursue recovery of fees, including any associated costs.

6. Cancellation and Termination

For Stripe subscriptions, you may cancel at any time via the Stripe Billing Panel, accessible from your user dashboard (https://app.spettro.io). Cancellation takes effect at the end of the current billing period; no prorated refunds are provided. For Cryptomus subscriptions, your subscription automatically expires unless manually extended. We may terminate or suspend your account at any time for violations of these Terms, non-payment, or non-extension of your subscription, without notice or liability. Upon termination or expiration, your access to configurations and allocated resources (e.g., static IPs) ends immediately.

7. Acceptable Use Policy

You may use the Service only for lawful purposes and in compliance with all applicable laws. You are responsible for your use of the configurations and any data transmitted through the VPN connections you establish.

8. Prohibited Activities

You agree not to:

• Use the Service for illegal activities, including but not limited to fraud, hacking, distribution of malware, or infringement of intellectual property.
• Overload or disrupt our systems.
• Resell, share, or distribute the configuration files.
• Use the Service in a way that harms us or other users.

Violations may result in immediate termination without refund.

9. Intellectual Property

The Service, including configurations and any related materials, are owned by us or our licensors and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the configurations for personal use during your active subscription. All rights not expressly granted are reserved.

10. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied, including uptime, speed, or security. We do not guarantee that the Service will meet your requirements or be uninterrupted, error-free, or secure. We are not liable for any third-party content accessed via the Service.

To the maximum extent permitted by law, our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim. We shall not be liable for indirect, consequential, incidental, or punitive damages, including lost profits or data.

11. Indemnification

You agree to indemnify, defend, and hold harmless Spettro, its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Italy, without regard to conflict of laws principles. Any disputes shall be resolved through binding arbitration in Italy, rather than in court, except for small claims. You waive any right to participate in class actions.

13. Changes to Terms

We may update these Terms at any time. Changes will be posted on this page (https://www.spettro.io/legal/terms-of-service) and become effective immediately. Your continued use constitutes acceptance. If changes are material, we may notify you via email.
